BALTIMORE (WBFF)-- BREAKING NEWS: A Judge declares a mistrial in Keith Davis Jr. murder trial after the jury says it was hung.
This is the third trial for the murder of Kevin Jones. Davis is charged with second-degree murder in the killing of the Pimlico security guard. Prosecutors call Davis a killer. The defense says he was set up by police, and his attorney referenced video that she claims could be the evidence to prove her client’s innocence.
Five hours after the murder, Davis was seen running from the scene of a car crash with a gun just blocks from the murder scene, according to prosecutors.
They say he was cornered by police in a garage nearby and a gun was recovered in the area with Davis' DNA, fingerprints and palm prints on it.
Davis Jr. was shot by police after they say he opened fire on them while hiding in an auto garage. His attorney says police shot him unprovoked. The civilian review board found that police used excessive force in his arrest.
In May of last year, a judge declared a mistrial, the jury deadlocked. In October, Davis was found guilty, that conviction was overturned. Thursday's hung jury ends the third trial for the man who has proclaimed his innocence.
There's no word if prosecutors will try the case again.
